This Privacy Policy explains what information Bliss & Zen Acupuncture Health and Wellness (https://www.blissandzenacupuncture.com/, "Site") collects through the website, how it’s used and your choices. It also explains how information you provide when booking appointments or making payments through our scheduling partner, Jane App, is handled.

This policy only covers the Bliss & Zen Acupuncture Health and Wellness Site. It does not replace, and should be read alongside our HIPAA Notice of Privacy Practices, which governs protected health information (PHI) collected as part of your care and is provided to patients separately (see Section 6 below).

1. Information We Collect on the Site

When you visit or use the Site, we may collect:

Contact Information

Contact information you provide directly such as your name, email address, phone number and any message content, when you use our Contact page or fill out a form on the Site.

We do not collect health information, medical history or appointment details through the Site. That information is collected separately through the Jane App, as described below.

2. Booking & Payments Through Jane App

Appointment scheduling and related payments for Bliss & Zen Health and Wellness are handled through the Jane App, a third-party practice management platform. This is accessed via a link from the Site (drjonichapman.janeapp.com). When you book an appointment, you leave the Site and interact directly with Jane's platform (drjonichapman.janeapp.com).

Jane is operated by Jane Software Inc., an independent company, not by Bliss & Zen Health and Wellness.
Jane collects and stores information such as your contact details, intake and health history forms, appointment records, and payment information, on our behalf, in order to schedule and bill for care.
Jane maintains its own security practices and privacy policy, and enters into a Business Associate Agreement (BAA) with our practice. Meaning, it is contractually required to safeguard health information consistent with the Health Insurance Portability and Accountability Act (HIPAA).
We encourage you to review Jane's Privacy Policy and Jane's Security practices directly, as your use of Jane's platform is also subject to Jane's terms.

Information you submit through Jane (including any health information) is protected under HIPAA and is not shared with us for marketing purposes, and is not covered by the website Privacy Policy for the Bliss & Zen Acupuncture Health and Wellness Site.

3. How We Use Information Collected on the Site

We use the information described in Section 1 to:

Respond to inquiries submitted through our Contact form or email.
Send you information you've requested, such as newsletters, if you opt in.
Improve and maintain the Site, understand how visitors use it, and troubleshoot issues.
Comply with legal obligations and protect against fraud or misuse of the Site.

We do not sell personal information collected through the Bliss & Zen Acupuncture Health and Wellness Site to third parties.

4. Cookies & Tracking Technologies

The Site is built on the Wix platform, which uses cookies and similar technologies to operate the website, remember preferences and gather analytics. We may also use tools like Google Analytics and/or the Meta (Facebook) Pixel to understand website traffic and measure the performance of our social media and advertising. Service providers who help us operate the website, process orders or send communications (ex. Wix, our e-commerce/payment processor, email service providers).
Jane App: only to the extent you click through to book an appointment or manage your account on Jane (see Section 2).
Legal authorities, if required by law, subpoena or to protect the rights, safety or property of Bliss & Zen Health and Wellness or others.
In connection with a business transfer such as a merger, acquisition or sale of assets.

We do not share your information with third parties for their own independent marketing purposes without your consent.

6. Health Information: HIPAA & California Law (CMIA)

Bliss & Zen Acupuncture Health and Wellness provides acupuncture and holistic wellness care, and health information you share with us as a patient (whether in person, on intake forms or through Jane App) is protected health information under both:

HIPAA (the federal Health Insurance Portability and Accountability Act), to the extent it applies to our practice, and
CMIA (California's Confidentiality of Medical Information Act, Civil Code § 56 et seq.), a California state law that applies broadly to California healthcare providers and in several respects is *stricter* than HIPAA. For example, it generally requires our written authorization for disclosures, imposes its own data-security and record-handling obligations, and gives patients a private right to sue directly for negligent or unauthorized disclosure of medical information, separate from any HIPAA complaint process.

Where CMIA and HIPAA overlap, we follow whichever standard is more protective of your information, as California law requires.

Our formal HIPAA Notice of Privacy Practices, which describes in detail how your health information is used, disclosed, and protected, and your rights regarding your health records under both HIPAA and CMIA, is provided to you separately as a new patient (through Jane's intake process and/or in our office) and is available upon request. This website Privacy Policy for Blissandzenacupuncture.com does not itself serve as our HIPAA Notice of Privacy Practices.

7. California Privacy Rights

This Site is operated from California and is intended for use in compliance with California privacy law, including the California Online Privacy Protection Act (CalOPPA) and the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA).

CalOPPA Disclosures

This Privacy Policy is posted on Blissandzenacupuncture.com and describes the categories of personal information we collect, how it is used and with whom it may be shared, as required by CalOPPA.
Do Not Track Signals: Some browsers offer a “Do Not Track” (DNT) setting. Because there is no common industry standard for responding to DNT signals, Blissandzenacupuncture.com does not currently respond differently based on DNT signals. We do, however, honor Global Privacy Control (GPC) signals as an opt-out preference signal where technically supported, consistent with CCPA/CPRA.

CCPA/CPRA Rights

If you are a California resident, subject to certain exceptions, you have the right to:

Know what categories and specific pieces of personal information we have collected about you, and the sources, purposes and third parties involved.
Delete personal information we've collected from you.
Correct inaccurate personal information.
Opt out of the sale or sharing of your personal information (as those terms are broadly defined under CPRA, which can include certain advertising/analytics data sharing). Please see the note on cookies and tracking below.
Limit the use of sensitive personal information, where applicable.
Non-discrimination for exercising any of these rights.

To make a request, contact us using the information in Section 11. We will verify your identity before fulfilling requests involving personal information.

Please note: CCPA/CPRA generally exempts protected health information governed by HIPAA and medical information governed by CMIA. So health information you share through Jane App or as our patient is handled under HIPAA/CMIA (Section 6), while general website data (contact form submissions, browsing data) falls under CCPA/CPRA.

8. Cookie & Tracking Consent (CIPA)

California's Invasion of Privacy Act (CIPA), originally a wiretapping law, has increasingly been applied by courts to website tracking technologies (including analytics tools, advertising pixels, session-replay software and chat widgets) when those tools capture visitor data before the visitor has consented.

To address this:

We disclose in Section 4 above the categories of cookies and tracking tools used on this website.
Where we use tools such as Google Analytics or Meta (Facebook) Pixel, we aim to configure our website's cookie consent mechanism so that non-essential tracking does not begin until you have had the opportunity to accept or decline it.
You may decline non-essential cookies through our cookie consent banner (where presented) or through your browser settings (as described in Section 4).

Google Analytics, a web analytics service provided by Google, Inc. (“Google”), is used on our website. The information generated by the cookie about your use of our website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use information generated by cookies and your IP address for website analytics and remarketing. Google’s privacy policy may be obtained here. Users may opt out of Google’s use of cookies by visiting the Google advertising opt-out page.

9. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site.

We use reasonable administrative and technical safeguards to protect information collected through the Site, consistent with CCPA/CPRA and, for health information, CMIA's data security requirements described in Section 6. However, no method of transmission or storage over the internet is completely secure and we cannot guarantee absolute security.
